1. Heard Mr. S. Islam, learned counsel for the petitioner and also heard Mr. B. Sharma, learned Addl. P.P. for the State.
2. In this petition under Section 483 BNSS, the accused-petitioner, namely, Afruza Khatun, who was arrested on 22.09.2025 in connection with Sessions Case No. 362/2025 under Section 61(2)/103(1) of BNS, 2023 pending in the
Page No.# 2/2 Court of learned Additional Sessions Judge, Dhubri, corresponding to Golakganj Police Station Case, is seeking bail.
3. As per the allegations contained in the FIR, the deceased person was called out at night by the main accused to go for fishing. Thereafter, the deceased was killed with the assistance of the present petitioner with whom the main accused was in a relationship. It also appears from the statements of the witness that the deceased had been blackmailing the petitioner and the main accused with regard to their relationship. The material available in the case diary clearly implicates the present petitioner as well. Although it is submitted by learned counsel for the petitioner that she is a lady having children who have to be looked after and has spent around 136 days behind bars.
4. It is the submission of learned Addl. P.P. that in view of the incriminating available against the petitioner, the prayer for bail may not be considered till some of the vital witnesses have been examined.
5. Having regard to the above and the gravity of the offence, the prayer for bail is rejected at this stage.
