This petition has been preferred by petitioner under Article 226 of the Constitution of India seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to direct the Respondent No.4/BALCO to stop the alleged construction of boundary wall immediately. 10.2 That, this Hon’ble Court may kindly be pleased to direct Respondent No.3/Collector to ensure that the notice dated 02/02/2026 and 03/02/2026, issued by Respondent No.4/Nagar Palik Nigam is complied with by the Respondent No.5/BALCO immediately. 10.3 Any other relief, which this Hon’ble Court may deem fit and proper, may also be passed in favor of the petitioner together with cost of the petition.” 3. Learned counsel for the petitioner submits that the petitioner is a resident of House No.921 of Nehru Nagar, Khasra No.356/1/a, Padhimar, Risda, District Korba. She further submits that respondent No.5/BALCO is raising a boundary wall on the land adjacent to the residence of the petitioner. She next submits that the aforesaid boundary wall is being constructed over Government Abadi land. On being complaint dated 16.02.2026 (Annexure-P/4) made by the petitioner to the Collector and the Commissioner, notices (Annexure- P/3 colly.) dated 02.02.2026 & 03.02.2026 have been issued by respondent No.4/the Building Officer, Municipal Corporation, Korba. However, no concrete action has been taken against respondent No.5 yet. Hence, learned counsel prays that this petition may be disposed of with a direction to respondent Nos.2 and 3 to take appropriate steps against respondent No.5 in respect of complaint (Annexure-P/4) dated 16.02.2026 and the notices (Annexure-P/3 colly.) dated 02.02.2026 & 03.02.2026. 3 4. Learned counsel appearing for the respondent Nos.1, 2 & 3 submits that appropriate steps shall be taken in respect of notices (Annexure- P/3 colly.) issued by respondent No.4 and the complaint (Annexure-P/4) made to respondent No.2 in accordance with law. 5. The grievance of the petitioner is that respondent No.5 is illegally raising construction over Government Abadi land. Therefore, considering the limited prayer made by the petitioner, this petition is disposed of at this stage directing respondent Nos.2 & 3 to take appropriate steps in respect of notices (Annexure-P/3, colly.) dated 02.02.2026 & 03.02.2026, as well as the complaint dated 16.02.2026 (Annexure-P/4) expeditiously, preferably within a period of 30 days from the date of receipt/submission of a copy of this order. 6. With aforesaid observations and directions, this writ petition stands disposed of. 7. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
