JUSTICE ANU SIVARAMAN) Heard the learned counsel appearing for the writ petitioner as well as the learned Special Public Prosecutor appearing for respondents No.1 to 5. 2. The facts pleaded in the present case are that, the petitioner is the wife of Sri. Sai Kumar B., who is the son of respondents No.4 and 5. The marriage between the petitioner and Sri. Sai Kumar B., was solemnized on 12.04.2004 at Hyderabad, and thereafter, they resided together at Secunderabad. It is stated that the petitioner herein is presently a resident of Bengaluru. 3. It is further contended that the petitioner's husband ceased all communications with her and that his number also became unreachable. It is stated that the petitioner has contacted respondents No.4 and 5 on - 5 - HC-KAR NC: 2026:KHC:34223-DB WPHC No. 66 of 2026 several occasions seeking information regarding the whereabouts of her husband, however, they failed to furnish any satisfactory information regarding his whereabouts. 4. On these averments, the writ petitioner has filed the present writ petition seeking a writ of Habeas Corpus directing respondents No.2, 3, 6 and 7 to secure and produce her husband before this Court and for further directions. 5. The learned Special Public Prosecutor appearing for respondent Nos.1 to 5 submits that the averments in the writ petition discloses that the marriage between the petitioner and her husband and the last place of residence of the petitioner and her husband was at Hyderabad. It is submitted that attempts were made to amicably settle the disputes between the parties also at Hyderabad, as is evident from Annexure-C dated 01.03.2026. It is further contended that no complaint has been registered before - 6 - HC-KAR NC: 2026:KHC:34223-DB WPHC No. 66 of 2026 any Police Station in Bengaluru in relation to the subject matter of the present petition and that no proceedings between the parties are pending before any Courts in Bengaluru. 6. In view of the above matter and in view of the averments made in the writ petition, we are of the considered opinion that the present writ petition seeking a writ of Habeas Corpus is not maintainable before this Court and the same is accordingly, disposed of, without prejudice to the rights and contentions of the parties to seek such remedies as may be available to them in accordance with law.
