PANKAJ JAIN, J. (ORAL)
The petitioners by way of present writ petition seek issuance of writ in the nature of mandamus directing respondents to halt the construction of road being undertaken at Upkar Nagar, Patiala.
Counsel for the petitioners submits that a fresh layer is being laid on the already constructed roads without scraping the earlier layer. This has led to elevation of the road level by 4-6 inches. It has led to a situation wherein the floor level of the petitioners’ houses has gone below the road level. This is causing inconvenience to the petitioners and is violating their right to life. 3
In the considered opinion of this Court, the issue with respect to rise in the road level or the floor level of the houses of the petitioners getting lower to the road are factual disputes. The same cannot be entertained and POOJA SHARMA 2026.07.10 14:35 I attest to the accuracy and integrity of this document

adjudicated in exercise of writ jurisdiction under Articles 226/227 of the Constitution of India. These factual aspects need to be decided on the basis of evidence led by parties. 4
In view of the above, the petitioners are relegated to avail of their alternative remedies, if any, in accordance with law. 5
Petition stands disposed off.
