Mr. Rajendra Banerjee, learned Additional Public Prosecutor along with Mr. P. Karan Singh, learned advocate, appears on behalf of the State. Their appointment may be regularized by the concerned authorities.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 5 years 4 months. Similarly placed accused person has been granted bail in CRM(M)970 of 2025 on the ground of prolonged detention.
Learned advocate for the State opposes the prayer for bail.
Having considered that the other accused who was granted bail on the ground of prolonged detention in course of the
2 trial by relying upon the provisions of Article 21 of the Constitution of India, the same benefit be extended to the petitioner. As such, the petitioner, namely, Prahlad @ Praladh Barman be released on bail by the learned ACJM, Ranaghat, Nadia on same terms and conditions as was imposed upon Debjit Das who was granted bail in CRM(M)970 of 2025.
Accordingly, CRM(M)2890 of 2025 is allowed.
