CORAM: JUSTICE G. SATAPATHY
DATE OF HEARING & JUDGMENT:22.07.2026(ORAL) G. Satapathy, J.
1.
Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.
2.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Tangi PS Case No.774 of 2023
BLAPL Nos.4371 & 4503 of 2026 Page 2 of 4 corresponding to ST Case No.155 of 2024 (GR Case No.760 of 2023) pending in the file of learned 2nd Additional Sessions Judge, Khurda, for commission of offences punishable U/Ss.302/201/34 of IPC, on the main allegation of committing murder of one child namely Soumyaranjan Pradhan, the grandson of the informant by forcefully drowning him.
3.
Heard, Mr. Bhawani Sankar Panigrahi,
learned counsel for the petitioner in BLAPL No.4371 of 2026; Mr. Dharanidhar Nayak, learned Senior Counsel, who enters appearance for the petitioner in BLAPL No.4503 of 2026 in Court today along with
learned counsel Ms. Anwesha Mishra by filing appearance memo, which is taken on record, and Mr. M.R. Patra, learned Addl. Public Prosecutor in the matter together with the copy of depositions of the witnesses PWs.1 to 14 as produced.
4.
After having considered the rival
submissions upon perusal of record, there appears allegation against the petitioners for committing
BLAPL Nos.4371 & 4503 of 2026 Page 3 of 4 murder of one child. No doubt, Mr. Nayak, learned Senior Counsel has put much emphasis on the implication of the petitioner-Prakash Parida on the basis of statement of co-accused, but the said petitioner has not only been implicated on the basis of statement of co-accused, but also his implication is on the basis of his disclosure statement. Besides, the implication of the petitioner-Prakash Pradhan @ Mukta is on the basis of the statement of eye witness-cum-PW7 and the informant-cum-PW5. Right now, the trial is going on and the allegation against the petitioners is not only serious, but also grave. In such view of the matter and taking into account the nature and gravity of the offence as alleged against the petitioners vis-à-vis the materials so placed on record and regard being had to the punishment prescribed for the offences as alleged against the petitioners and taking into account the law laid down by the Apex Court in X Vrs. State of Rajasthan (2024) SCC Online SC 3539 and there being no change in circumstance in considering the bail
BLAPL Nos.4371 & 4503 of 2026 Page 4 of 4 applications of the petitioners afresh after refusal of bail to them in BLAPL Nos.12466 & 11127 of 2025
disposed of on 18.12.2025, this Court is not inclined to grant bail to any of the petitioners.
5.
Hence, these two bail applications of the petitioners namely Prakash Pradhan @ Mukta (In BLAPL No.4371 of 2026) and Prakash Parida (In BLAPL No.4503 of 2026) stand rejected. Accordingly, these BLAPLs stand disposed of. A copy of this order be immediately transmitted to the learned trial Court for reference.
