This Civil Petition is filed by the wife for transfer of M.C.No.43/2025, filed by the respondent- husband for divorce, pending before the Court of Senior Civil Judge and JMFC, Tiptur. 3. Learned counsel for the petitioner stated that the petitioner is residing at Nelamangala along with her parents. She is presently working and the parties do not have any children. The respondent is an agriculturist residing at Tiptur. The distance between Nelamangala and Tiptur is 122 kilometres. It is further stated that the petitioner has also filed Crl.Misc.No.354/2025 under - 3 - HC-KAR NC: 2026:KHC:33937 CP No. 453 of 2025 Section 12 of the Protection of Women from Domestic Violence Act, 2005 and it is still pending. 4. Learned counsel for the petitioner stated that initially when the matter was not commenced for trial, he filed this application. But during the pendency of this petition, the Trial Court proceeded with the evidence. However, considering the stage of the divorce proceedings pending before the Trial Court, this Court finds that it is just and reasonable to direct the petitioner herein to file an affidavit and the documents can be marked through online. The petitioner may also be examined through a Commissioner or by way of video conferencing. In the event the personal presence of the petitioner before the Trial Court at Tiptur is required, the respondent-husband shall incur the travelling and stay expenses of the petitioner. 5. With these observations, now at this stage this Court doesn't want to disturb the proceedings pending - 4 - HC-KAR NC: 2026:KHC:33937 CP No. 453 of 2025 before the Trial Court.
