1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 322/2026 registered at Police Station Purani Bhilai, District - Durg, (C.G.) for the offence ANKIT KUMAR SINGH Digitally signed by ANKIT KUMAR SINGH

As per the prosecution’s case, in brief is that on 24.06.2026 the written complaint has been filed by the prosecutrix alleging that the prosecutrix herself works in the HDFC Bank, Smriti Nagar, Supela and she knows the applicant since last 1 year. On 10.11.2025 the applicant took the prosecutrix to his house at village Jarwai and committed sexual intercourse on the false pretext of marriage. The applicant on many occasions has committed sexual intercourse with the prosecutrix and on 30.05.2026 committed the same with her for the last time, upon being asked for marriage he refused to do the same. In view of the above incident, FIR was registered against the present applicant and initiated steps to arrest him in connection with the alleged commission of the offence. Hence, the present anticipatory bail application.
3. Learned counsel for the applicant submits that the applicant has not committed any offence as alleged and has been falsely implicated crime in question. It is further contended that the applicant and the victim both used to work in different banks and known to each other for the last one year and applicant has never given her false hopes of marriage and committed sexual intercourse with her. The applicant
3 MCRCA No. 1143 of 2026 has already made a written complaint against the victim informing about the threat given by her for implicating him in false criminal case. Hence, it is prayed that the applicant be granted anticipatory bail.
4. On the other hand, learned State counsel, appearing for the non-applicant/State, opposes the submission made by the
learned counsel for the applicant and submits that the present applicant has committed sexual intercourse with the victim on the pretext of marriage, therefore, the applicant is not entitled to the discretionary relief and the application for grant of anticipatory bail deserves to be rejected.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, the nature of allegations and the material available on record, it appears that the applicant and the victim used to know each other for the last one year and the victim having been consensual relationship with the applicant and when their relationship could not materialize and the applicant refused to marry, she lodged the present FIR that on the pretext marriage applicant compelled her to make physical relationship with him. However, applicant has already made a written complaint against the victim informing about the
4 MCRCA No. 1143 of 2026 threat given by her for implicating him in false criminal case and, therefore, he might be falsely implicated in the crime in question, as such, this Court is of the considered opinion that the applicant deserves to be enlarged on anticipatory bail.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Prashant Kumar Dewangan on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The applicant(s) shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant(s) shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant(s) shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant(s) and the surety shall submit a copy of his aadhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicant(s) shall not involve himself in any offence of similar nature in future. Sd/- (Ramesh Sinha)
