This appeal under Section 173 of the Motor Vehicles Act, 1988 has been preferred by the appellant herein/Insurance Company seeking exoneration from its liability to pay the amount of compensation saddled by the Claims Tribunal, challenging the impugned award dated 5-11-2018 passed by the 1st Additional Presiding Officer to the 1st Additional Motor Accident Claims Tribunal, Raipur in Motor Accident Claim Case No.74/2013, whereby the learned Claims Tribunal has awarded a total sum of ₹ 1,53,891/- along with interest @ 9% per annum as compensation for the injury sustained by the claimant/ respondent No.1 herein.
2. Mr. Utsav Mahiswar, learned counsel appearing on behalf of the appellant herein/Insurance Company, would submit that excessive compensation has been granted to the claimant which deserves to be reduced.
3. None present for the respondents.
4. I have heard learned counsel for the appellant herein/Insurance Company and considered his submission and also gone through the record with utmost circumspection.
5. After hearing learned counsel for the appellant and going through the record, I do not find any merit in this appeal and liability to pay the compensation is fastened upon the appellant herein/Insurance Company. Accordingly, the appeal deserves to be and is hereby dismissed. No order as to cost(s).
