The complainant has filed the present complaint alleging willful disobedience of the order dated 10.04.2017 passed by the learned Single Judge in WP.Nos.15050-15052/2017 (LA-BDA) and W.P.Nos.15103-15104/2017. - 3 - HC-KAR NC: 2026:KHC:35020-DB CCC No. 1014 of 2025 2. In terms of the said interim order, the court directed that the complainant shall not be dispossessed from the property in question, if not already dispossessed. The complainant claims that he continued to be in possession of the subject property, but was dispossessed on 26.07.2025. The accused stoutly disputes the same. 3. It is the case of the accused that the property in question was allotted to the accused vide allotment letter dated 20.01.2016, and the possession certificate in respect of the same was issued on 20.02.2016. The accused has also produced the possession certificate issued by the BDA. Although the complainant claims that his furniture and belongings had been thrown out of the house and, he and his family members were forcibly evicted. There is no material produced to establish the same. The complainant has produced photographs, which were filed in the writ petition. These photographs indicate that the details of the writ petition had been painted on the walls of the property in question. The complainant has also produced photographs, which he claims are recent, showing that the outer walls have been repainted, thus, removing the references of the High Court writ petition and the stay order. - 4 - HC-KAR NC: 2026:KHC:35020-DB CCC No. 1014 of 2025 However, these photographs also indicate that some of the walls still refer to the details of the writ petition. 4. We are unable to ascertain from the material on record whether the complainant has been dispossessed after the order dated 10.04.2017. 5. We are informed that the writ petition is listed before the court next week. We close the present complaint while reserving the complainant all rights and contentions in the pending proceedings.
