The petitioner, who is the wife of the detenu-Veeresh (CTP No.10366) is before this Court seeking for the following reliefs: a) Issue a Writ of Mandamus by directing the Respondent No.2/Central Prison, Bangalore to release the Petitioner on Emergency Parole for a period of 30 days and Prisoner CTP No. 10366 to take care of the convict wife i.e., the petitioner and she has is 6 months pregnant and the petitioner wants to be with her some days for medical support and financial, in the interest of justice and equity. b) Issue such other suitable orders or direction as this Hon'ble court deems fit and proper in the nature and circumstances of the case, in the interest of justice and equity. 2. The detenu had been convicted in Spl.CC.No.453/2017 for offences under Sections 376 of IPC r/w Section 5(m) r/w 6 of POCSO Act, 2012, - 3 - HC-KAR NC: 2026:KHC:33867 WP No. 19833 of 2026 307 of IPC r/w 5(r) r/w 6 of POCSO Act and Section 201 of IPC by the LIII Additional City Civil and Sessions Judge, Bengaluru and sentenced on 30.04.2018 with the highest of the sentence being imprisonment for life. The detenu has served a period of 08 years 03 months 08 days of imprisonment as on 13.03.2026. The petitioner having made an application for parole, the same came to be rejected. The reason for parole now put forward by the detenu is on account of the pregnancy of his wife. 3. Learned AGA opposes the above petition on the ground that the period of 6 months from the last completion of parole has not been completed inasmuch as the detenu had reported back on 06.03.2026 and is not eligible for consideration of parole until 06.09.2026. - 4 - HC-KAR NC: 2026:KHC:33867 WP No. 19833 of 2026 4. A perusal of the papers indicates that as on 27.05.26 she was pregnant for a period of 18 weeks. 5. Being of the considered opinion that full gestation has not been achieved, it would be better for the detenu to avail of parole at the time of delivery, the present petition stands dismissed. 6.
