JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioners are before this Court seeking for the following reliefs: a. Issue a writ of certiorari to Quash the election Conducted at the Red Cross Society in the Davanagere and the result (ANNEXURE-Srage No holding this election was the violation of bye-laws of the Indian Red Cross Society Act 1920, and b. Issue a direction to the Deputy Commissioner, Davanagere, in his capacity as the ex-officio President and supervisory authority of the Indian Red Cross Society, Davanagere District Branch, to hold a detailed and independent enquiry into the irregularities, illegal inclusion of ineligible voters, post-result membership approvals, and booth-wise malpractices that occurred during the vide Annexure-s dtd 24/9/25 election held on 14/09/2025, and to submit a report to this Hon'ble Court within a stipulated period, and to initiate necessary disciplinary and corrective actions - 5 - HC-KAR NC: 2026:KHC:34887 WP No. 34300 of 2025 against the officials responsible for such misconduct. c. issue a writ of mandamus directing the respondents to conduct elections only after strict adherence to the bye-laws, the Indian Red Cross Society Act 1920, and due process, with adequate notice, complete member rolls, and member participation. d. Issue any other writ, order or direction and such other and further relief as this Hon'ble Court deems fit in the facts and circumstances of the case, in the ends of justice. 2. A memo for withdrawal dated 08.07.2026 has been filed signed by the counsel for the petitioners, which reads as under: "It is respectfully submitted that the petitioners have sought reliefs relating to the quashing of the election proceedings and other consequential reliefs. However, as the election proceedings are required to be challenged before the competent authority, the present petition came to be filled before this Hon'ble Court due to an inadvertent oversight. The petitioners therefore seek permission to withdraw the present petition with liberty to institute a fresh election petition before the competent forum, in accordance with law.
