1. The petitioner has challenged the transfer order dated 30.9.2022, whereby he was transferred from the office of the Collector Land Records, Durg to office of the Collector Land Records, Bemetara.

Learned counsel for the petitioner would submit that the petitioner is a Class-III employee, who was transferred outside the District whereas, the seniority of a Patwari is maintained at the District Level.

Learned counsel appearing for the State would oppose the
submissions made by counsel for the petitioner.
4. I have heard learned counsel for the parties and perused the documents present on record.

Having considered the facts and circumstances of the case, the petitioner, who was holding the post of Patwari was transferred outside the District whereas, the seniority of a Patwari is maintained at the District Level, therefore, the order of transfer pertaining to the petitioner is not sustainable in the eyes of law and is accordingly quashed. However, the respondent authorities would be at liberty to take an appropriate decision with regard to transfer of the petitioner, if occasion arises in near future, in accordance with law.
6. With the aforesaid observation(s), this petition is disposed of. Sd/-
