This application under Article 227 of the Constitution of India is at the instance of the mother and is directed against the orders dated 5th February, 2024, 28th July, 2025 and 5th May, 2026 all passed by the learned Additional District Judge, 15th Court at Alipore in ACT VIII Case No. 116 of 2019. When this matter is taken up for hearing the learned advocates for the respective parties uniformly submit that the parties are agreeable to get a psychological assessment and counseling of the child done at the Department of Psychology, University of Calcutta. Mr. Banerjee, learned advocate appearing for the petitioner/mother submits that as per the prevailing practice of the Calcutta University for psychological assessment and counseling, the parties have to first approach the concerned head of the department who shall
2 nominate an expert as per the directions passed by the impugned order. The learned advocates for the respective parties, on instructions from their respective clients, suggest that 17th July, 2026 at about 12 noon the parties shall appear before the concerned head of the department for taking steps for the psychological assessment and counseling of the minor child done by the expert. In the light of the submissions made by the learned advocates for the respective parties, C.O. 2119 of 2026 stands disposed of with the following orders:
1. The mother shall escort the minor child Antareep Majumder to the Head of the Department of the Department of Psychology, Calcutta University on 17th July, 2026 at or about 12 noon. 2. The opposite party/father shall also remain present before the concerned head of the department on 17th July, 2026 at or about 12 noon. 3. The Head of the Department of the Department of Psychology, University of Calcutta shall nominate an expert for the purpose of psychological assessment and counseling of the minor child in terms of the directions contained in the order dated 5th May, 2026. It will be open to the concerned Head of the Department to decide as to
3 whether an expert or team of experts shall be nominated for such purpose. 4.
The Head of the Department is requested to fix a short date for such purpose after considering the availability of the experts. It is however made clear that the other portions of the impugned orders have not been interfered with by this Court. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Hiranmay Bhattacharyya, J.)
