The petitioners are languishing in custody for more than a year. Learned advocate also submits that in the charge-sheet number of witnesses have been referred to and there is no possibility of the trial being concluded in the near future. Learned advocate emphasizes that there has been subsequent change on the evidence having been adduced, as such, learned advocate prays that the petitioners may be released on bail. None appears on behalf of the State. Having considered the quantum of seizure, I am of the view that the rigors of Section 37 of the NDPS Act is 2 attracted, as such, I am not inclined to enlarge the petitioners on bail. Hence, the prayer for bail of the petitioners is Rejected. Accordingly, CRM (NDPS) 861 of 2026 is dismissed.
