These are the First bail applications filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants namely Ajay Sidar in MCRC No.2300/2026 and Pratham Kumar & Ajay Ravi in MCRC No.4223/2026 who have been arrested in connection with Crime No. 17/2025 registered at Police Station – Mahila Thana, Ambikapur, District – Surguja (C.G.), for the offence punishable under Sections 3, 4, 5 and 7 of the Immoral Traffic (Prevention) Act, 1956. 2. The prosecution story, in brief, is that applicants along with co-accused persons were involved in immoral trafficking and the used to transmission of photographs of girls to prospective customers through mobile phones and informing about the rates and earning commission and used to proved customers to co-accused persons who were allegedly earning their livelihood illegally by providing rooms in their house for the purpose of prostitution. Hence these applications. 3. Learned counsels for the applicants would submit that the present applicants are innocent persons and have been falsely implicated in the aforesaid case. They would also submit that the applicants have no criminal antecedents.
They would further submit that the other co-accused
3 persons, namely, Subhadra Rai, Laxmi Vishwas, Indrapati Sarthi @ Pooja, Nandini Kumari @ Komal, have already been granted regular bail by this Court vide order dated 11.12.2025, 9.01.2026, 12.01.2026 & 10.03.2026 in MCRC Nos. 10225/2025, 210/2026, 325/2026, & 2162/2026, respectively. Therefore, the applicants are also entitled to be released on regular bail on the ground of parity. They would also submit that applicant Ajay Sidar is in jail since 17.02.2026 & applicants Pratham Kumar and Ajay Ravi are in jail since 25.03.2026 and the trial is likely to take some time for its conclusion, therefore, they pray for grant of bail. 4. On the other hand, learned State counsel would oppose the bail application of the applicants and submit that the charge- sheet has not filed in MCRC No.2300/2026 and in MCRC No.4223/2026 charge-sheet already been filed. However, she could not dispute the fact that an identically situated co- accused persons have already been granted regular bail by this Court. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, that the applicants have no criminal antecedents, further, the fact that the other co-accused person, namely, Subhadra Rai, Laxmi Vishwas, Indrapati Sarthi @ Pooja, Nandini Kumari @ Komal, have already been granted regular
4 bail by this Court vide order dated 11.12.2025, 9.01.2026, 12.01.2026 & 10.03.2026 in MCRC Nos. 10225/2025, 210/2026, 325/2026, & 2162/2026, respectively, also considering the fact that the charge-sheet has already been filed before the competent Court in MCRC No.4223/2026 though in MCRC No.2300/2026 charge-sheet has not yet been filed, however, considering the detention period of the applicants as applicant Ajay Sidar is in jail since 17.02.2026 & applicants Pratham Kumar and Ajay Ravi are in jail since 25.03.2026 and conclusion of the trial may take some more time, this Court is of the view that the applicants are entitled to be released on bail in these cases on the ground of parity. 7.

Let the Bail of the Applicants – Ajay Sidar, Pratham Kumar and Ajay Ravi involved in Crime No. 17/2025 registered at Police Station – Mahila Thana, Ambikapur, District – Surguja (C.G.), for the offence punishable under Sections 3, 4, 5 and 7 of the Immoral Traffic (Prevention) Act, 1956, be released on bail on furnishing personal bond with two local sureties each in the like sum to the satisfaction of the Court concerned with the following conditions:- (i) The applicant(s) shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. 5 (ii) The applicant(s) shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him under Section 269 of Bharatiya Nyaya Sanhita. (iii) In case, the applicant(s) misuses the liberty of bail during trial and in order to secure his presence, proclamation under Section 84 of BNSS. is issued and the applicant fails to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against him, in accordance with law, under Section 209 of the Bharatiya Nyaya Sanhita. (iv) The applicant(s) shall remain present, in person, before the trial court on the dates fixed for (i) opening of the case, (ii) framing of charge and (iii) recording of statement under Section 351 of BNSS. If in the opinion of the trial court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the trial court to treat such default as abuse of liberty of bail and proceed against him in accordance with law. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
