CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE R. RAGHUNANDAN RAO DATE : 19th February 2026 P C :
Against the order passed by the District Consumer Disputes Redressal Commission-II, Vijayawada in C.C. No.147 of 2019 dated 04-09-2024, an appeal was preferred before the Andhra Pradesh State Consumer Disputes Redressal Commission at Vijayawada vide F.A.No.226 of 2025, which was delayed by 164 days.
2. The application for condonation of delay came to be dismissed by the State Consumer Commission on account of the fact that there were no grounds incorporated in the said application which would justify the condonation of the said delay.
2
3. A revision was preferred before the National Consumer Disputes Redressal Commission, New Delhi vide Revision Petition No.1402 of 2025, which too came to be dismissed on similar grounds that the application for condonation of delay did not contain any good reasons at all. A copy of the condonation of delay application has not been placed on record. However, the relevant paragraph of the application seeking condonation of 164 days delay has been reproduced in the order of the National Commission, which reads as under:-
“For the reasons stated in the accompanying affidavit the petitioners humbly pray the Hon’ble Commission may be pleased to condone the delay of 164 days in filing the appeal against order Dt.04-09-2024 passed by the District Consumer Commission-2 Vijayawada vide C.C. No.147/2019, else we shall stand to suffer great loss and hardship and for such order and further reliefs deemed fit and proper in the interest of justice and equity.”
The affidavit filed in support of the application reads as under:-
“The appeal has to be filed before this Hon’ble Commission within 45 days from the date of receipt of this order. The order is received on 04-09-2024 and the disposal date is 05.09.2024 and the appeal to be filed on or before 20-10-2024. The appeal has been filed on 02.04.2025 and there is a delay of 164 days in filing the appeal.”
4.
Learned counsel for the petitioners, however, does admit that apart from what has been reproduced in the order of the National Commission, the application for condonation of delay indeed did not contain any other relevant averment which would justify the condonation of the delay.

5. If that be so, we feel that the view expressed by not only the National Commission but also the State Commission cannot be interfered with. We find no merit in the present petition, which is, accordingly, dismissed. No costs.
Pending miscellaneous applications, if any, shall stand closed.
