floated
by
the
private
respondents/ requisitionists/members before the Prescribed Authority on June 22, 2026 on the ground that the motion contains a stigma against the Pradhan and cannot be sustained. It appears from the motion that the requisitionists have alleged inefficiency, bias and nepotism of the Pradhan which are undoubtedly stigmatic remarks. Section 12 of the West Bengal Panchayat Act, 1973 does not provide any opportunity to the Pradhan to defend the allegations made against her in the motion. Such allegation is likely to adversely affect in her future political pursuits.
In view of the above, the no confidence motion dated June 22, 2026 is set aside/quashed. However, the members/ requisitionists are at liberty to submit a fresh motion before the Prescribed Authority in terms of Section 12 of the Act of 1973. In the event such motion is submitted, the Prescribed Authority shall deal with the same in accordance with the provisions laid down under Section 12 of the Act of 1973. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
