Aishwarya Rajyashree, Adv. Debashish Basak, …for the State. Affidavit of service filed by the petitioner is taken on record. The Panchayat is not represented despite service. The petitioner and the private respondents are cosharers in respect of undivided plot of land. The petitioner alleges that the private respondents are raising construction therein without obtaining sanction from the concerned Panchayat. He filed a complaint before the concerned Panchayat in this regard on 1st July, 2026 and seeks consideration of the same. Learned counsel for the private respondents submits that the concerned authority be directed to deal with the complaint upon granting the private respondents reasonable opportunity of hearing. Learned counsel for the State submits that pursuant to the complaint filed by the petitioner, the Pradhan, Bethuadahari I Gram Panchayat has fixed 21st July, 2026 for hearing. Notice of hearing has been issued upon the parties. In view of the above, the Pradhan, Bethuadahari Gram Panchayat, being the 6th respondent herein, is 2 directed to consider and dispose of the complaint submitted by the petitioner upon hearing both the parties and pass a reasoned order within four weeks from the date of communication of this order, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event of unauthorised construction being raised by the private respondents, the concerned authority shall take necessary steps in accordance with law. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
