1. The petitioner has filed the present writ petition challenging the order passed by the Legal Remembrance and Ex-Officio of the Principal Secretary to the Government of West Bengal, Judicial Department being memo no. 3519-C/PE- 195A/2024 dated 2nd July, 2025 wherein Mr. Apurba Das, learned APP attached to the learned ACJM, Kalna, Purba Burdwan is posted at J.M., 2nd Court Coochbehar as a Special Public Prosecutor.
2. Learned counsel for the petitioner submits that the petitioner intending that Mr. Apurba Das should conduct the G.R. case no. 426 of 2013, G.R. Case No. 475 of 2017 and G.R. Case No. 619 of 2012 pending before the Judicial Magistrate, 2nd Court and 3rd Court, Chandannagar, Hooghly.
3. Learned Additional Advocate General has handed over the copy of the order passed by this Court in
2 WPA 26110 of 2025 (Suraj Sur vs. The State of West Bengal & Ors.) and submits that the petitioner has suppressed the said order wherein this Court finds that Smt. Lopamudra Das Nandi was appointed as learned APP (Service) attached to the Court of learned 3rd Court of Judicial Magistrate, Chandannagar, Hooghly and Smt. Tamali Biswas was appointed as learned APP (Service) attached to the Court of learned 2nd Court of Judicial Magistrate, Chandannagar, Hooghly.
4. Taking into consideration of the appointment of the said learned APP’s, this Court has not passed any further order for appointment any other APP’s.
5. This Court finds that already two APP’s have been appointed to conduct the aforementioned cases.
6. The request of the petitioner that Mr. Apurba Das should be appointed for conducting the aforementioned G.R. cases, cannot be acceded to as he has been posted at the Court of Judicial Magistrate of Coochbehar as Special Public Prosecutor.
7. Considering the same, this Court did not find any merit.
8. Accordingly, the writ petition is dismissed.
