The revisional application has been preferred by the wife/petitioner praying for transfer of Matrimonial Suit No. 26 of 2024 under Section 13 of the Hindu Marriage Act, 1955, from the Court of the learned Additional District & Sessions Judge, Ranaghat, Nadia to the Court of the learned Additional District & Sessions Judge, Barrackpore, North 24 Parganas. 2. It is the case of the petitioner/wife that she is residing with her minor child at Matangini Hazra Road, Ushumpur, Gangulipara, P.O.- Agarpara, P.S. Ghola, District-North 24 Parganas. 3. On the other hand the husband/opposite party is a residing at Srinathpur, Court Para, P.O.+ P.S.- Ranaghat, District-Nadia. 4. Considering the said difficulty of the petitioner/wife having a minor child, to travel to 2 Nadia on regular basis, this Court relying upon the judgments of the Hon’ble Supreme Court in N.C.V. Aishwarya vs A.S. Saravana Karthik Sha, in Civil Appeal No(s). 4894 of 2022 (arising out of SLP (C) No(s). 16465 of 2021), decided on July 18, 2022, (Para 11, 12), directs that Matrimonial Suit no. 26 of 2024 be withdrawn from the Court of the learned Additional District & Sessions Judge, Ranaghat, Nadia and be transferred to the Court of learned District & Sessions Judge, Barrackpore, North 24 Parganas. 5. The Learned District & Sessions Judge, Barrackpore, North 24 Parganas, shall proceed with the suit in accordance with law with due notice upon both the parties. 6. Keeping in mind the case of the petitioner herein, the learned District & Sessions Judge, Barrackpore, North 24 Parganas, shall be at liberty to permit the parties to appear virtually, if such prayer is made. 7. CO 1370 of 2025 along with CAN 1 of 2025 are also disposed of. 8. Parties to act on the server copy of this order. 9.
