02/ 06.04.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Gawan P.S. Case No. 136 of 2023, registered under sections 304, 338 of I.P.C, pending in the Court of learned J.M. Ist Class at Giridih.

Learned counsel for the petitioner submits that law point is involved in the present anticipatory bail application and in view of that this is third anticipatory bail application.

Learned counsel for the State opposes the prayer and submits that twice anticipatory bail application of the petitioner has been withdrawn and thereafter present anticipatory bail application has been filed. He next submits that what is being argued by the learned counsel for the petitioner that point was already there in the earlier anticipatory bail applications however twice anticipatory bail applications have been withdrawn by the petitioner.

In view of above, it transpires that what is being argued by the
learned counsel for the petitioner that point was already there in the earlier anticipatory bail applications insptie of that twice anticipatory bail applications have been withdrawn by the petitioner. By order dated 15.09.2025 the anticipatory bail application of the petitioner was dismissed

as withdrawn with liberty to comply the observations made by the learned Sessions Judge passed in A.B.P. No. 1021/2025. No fresh ground is made in third anticipatory bail application. As such this anticipatory bail application is dismissed.
