This is the second bail application filed under Section 483 of the Bhartiya Nagrik Shuraksha Sanhita for grant of regular bail to the applicants who have been arrested on 10/10/2024 in connection with Crime No.198/2024, registered at Police Station Pithora, District Mahasamund (CG) for the offence punishable under Sections 103 (1), 238/3 (5) of Bhartiya Nyaya Sanhita, 2023. 2. First bail application was dismissed on merits by this Court on 10.01.2025 in MCRC No.8317/2024. 2 3. Case of prosecution, in brief, is that Kikhleshwar Sahu alias Munnu (younger brother of complainant) had gone missing since night of 23/09/2024 and when he did not return till 25/09/2024, complainant lodged a missing report in the police station. Thereafter on 27/09/2024 at about 12 o’clock it was informed by one Pitamber Dhruv that some foul smell is coming from the boundary of his field, thereafter, they reached there to see it and subsequently, the police reached the spot and took out dead-body of brother of complainant. During investigation, it was revealed that death of deceased was caused by applicants alongwith other co-accused. Hence, applicants have been arrested in the alleged crime. 4. Learned counsel for applicants submits that this second bail application is filed in change circumstances. He also pointed out that co-accused/Krishna Kumar Pate has been granted bail by this Court vide order dated 09.12.2025 in MCRC No.10084/2025. 5. Learned State Counsel opposes the bail application of applicants. 6. Heard learned counsel for parties. 7. Perusal of grounds does not reflect that any new ground has been pleaded in application, hence, I do not find any change in circumstances to admit this second bail application. 8.
