This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the Applicant who is apprehending her arrest in connection with Crime No.121/2026 registered at Police Station – Vidhansabha, District Raipur (C.G.) for the offences SISTLA NEELIMA VISHNU PRIYA Digitally signed by SISTLA NEELIMA VISHNU PRIYA Date: 2026.07.21 18:27:19 +0530 2 punishable under Sections 316(4), 336(3), 340(2), 338 and 61(2) of BNS. 2. The prosecution case, in brief, is that a written complaint was lodged by the Deputy General Manager of Maushwarya Infrastructure Ltd. alleging that the main accused Manish Biswas, while working as Senior Manager (HR), misused his official position and by preparing forged salary records in the names of former employees and others, embezzled a sum of Rs.3,38,34,846/- from the company during the period from 2021 to 2026. During investigation, co-accused Manish Biswas, in his memorandum, disclosed that an amount of Rs.5,05,500/- was transferred to the bank account of the present Applicant. It is further alleged that the Applicant had sold her IDFC Bank account kit, passbook and ATM card to co-accused Ramnarayan Sinha for Rs.10,000, who thereafter used the said account for routing and withdrawal of the embezzled amount. On the basis of the material collected during investigation, the prosecution alleges the prima facie involvement of the present Applicant in the commission of the aforesaid offences. Hence, this application. 3. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is submitted that the Applicant had no role in the 3 alleged embezzlement or forgery and is no longer an employee of the company. It is further submitted that although certain amounts were transferred to the Applicant's bank account by the main accused, she had no knowledge of such transactions, as the account was allegedly being operated and controlled by the main accused. It is also submitted that similarly situated co-accused i.e. Bandana Chaudhari and Ghanshyam Agrawal have already been granted anticipatory bail by this Court vide order dated 13.05.2026 passed in M.Cr.C(A) No.742/2026 and 745/2026 respectively; co-accused Robin Kumar Agrawal, Neelam Agrawal and Kamlesh Sao have been granted anticipatory bail vide order dated 18.06.2026 passed in M.Cr.C(A) Nos.800/2026 and 833/2026 respectively; co-accsued Varsha Andani has been granted anticipatory bail vide order dated 29.06.2026 passed in M.Cr.C(A) No.937/2026 and co- accused Ram Narayan Sinha has also been granted anticipatory bail vide order dated 02.07.2026 passed in M.Cr.C(A) No.1004/2026. It is lastly submitted that conclusion of the trial is likely to take considerable time and therefore, the Applicant may be granted anticipatory bail on the ground of parity. 4. On the other hand, learned State Counsel opposes the grant 4 of anticipatory bail to the Applicant. 5. Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature of allegations, the fact that the Applicant is no longer an employee of the company and also taking into consideration that similarly situated co-accused Bandana Chaudhari and Ghanshyam Agrawal have been granted anticipatory bail by this Court vide order dated 13.05.2026 passed in M.Cr.C.(A) Nos. 742/2026 and 745/2026 respectively; Robin Kumar Agrawal, Neelam Agrawal and Kamlesh Sao have been granted anticipatory bail vide order dated 18.06.2026 passed in M.Cr.C.(A) Nos. 800/2026 and 833/2026 respectively; Varsha Andani has been granted anticipatory bail vide order dated 29.06.2026 passed in M.Cr.C.(A) No. 937/2026 and Ram Narayan Sinha has also been granted anticipatory bail vide order dated 02.07.2026 passed in M.Cr.C.(A) No. 1004/2026 and without further commenting anything on the merits of the case, this Court is of the considered opinion that it is a fit case to extend the benefit of anticipatory bail to the present Applicant on the ground of parity. 6. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the Applicant – Divya Jhariya, 5 on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) The Applicant/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such fact to the Court. (b) The Applicant/s shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant/s shall appear before the trial Court on each and every date given to him/her/them by the said Court till disposal of the trial. (d)The Applicant/s and the surety shall submit a copy of his/her/their adhaar card along with a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
