This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending her arrest in connection with RUCHI YADAV Digitally signed by RUCHI YADAV 2 Crime No.77/2026 registered at Police Station – Golbazar, District- Raipur Commissionerate (C.G.) for the offence punishable under Section 318 (4) of BNS, 2023. 2. The prosecution story, in brief, is that on the basis of a written complaint lodged by Dr. Nidhi Gwalre, Deputy Director (Nursing), Directorate of Health Services, Chhattisgarh, Raipur, at Police Station Golbazar, it was alleged that pursuant to the order dated 07.04.2026 issued by the Additional Secretary, Government of Chhattisgarh, Public Health and Family Welfare Department, Mantralaya, Raipur, an inquiry revealed that Smt. Durgawati Usare (Kunjam), while posted as Registrar, Chhattisgarh Nurses Registration Council, Raipur-cum-Principal, Government G.N.M. Training Centre, Kanker, had proposed the registration of candidates on the basis of forged and fabricated documents and had committed financial irregularities, thereby causing wrongful loss to the Government. Based on the said complaint, the present crime was registered against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is contended that the applicant has no criminal antecedents. Learned counsel further submits that co-accused Narendra Dewangan has already been granted anticipatory bail by this Court vide order dated 22.06.2026 passed in MCRCA No. 774 of 2026. It is further submitted that another co-accused, Mathew Fernandez, has also been granted anticipatory bail by this Court 3 vide order dated 09.07.2026 passed in MCRCA No. 1027 of 2026. Therefore, on the ground of parity, the present applicant is also entitled to the grant of anticipatory bail. Accordingly, it is prayed that the applicant be enlarged on anticipatory bail. 4. On the other hand, learned State counsel vehemently opposes the prayer for grant of anticipatory bail and submits that the offences registered against the applicant are serious and therefore, it is submitted that the anticipatory bail application of the applicant deserves to be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Having considered the nature of the allegations, the material available on record, the fact that the applicant has no criminal antecedents and further taking into consideration that co-accused Narendra Dewangan and Mathew Fernandez have already been granted anticipatory bail by this Court vide orders dated 22.06.2026 passed in MCRCA No. 774 of 2026 and 09.07.2026 passed in MCRCA No. 1027 of 2026, respectively, this Court is of the considered opinion that the present applicant is entitled to the benefit of parity. Without expressing any opinion on the merits of the case, the application deserves to be and is accordingly allowed. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant –Durgavati Usare on executing a personal bond and one surety in the like sum to the 4 satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) she shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such fact to the Court. (b) she shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) she shall shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card along with a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
