This is the First bail application >led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the applicant who has been arrested in connection with Crime No. 977/2025 registered at Police Station – Civil Line, District – Bilaspur (C.G.), for the oCence punishable under Section 20(B) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 319, 388 and 340(2) of the Bhartiya Nyaya Sanhita, 2023. 2. The prosecution story, in a nutshell, is that on 23.08.2025, the police of Police Station Civil Lines, Bilaspur, received secret information that two ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.03.19 15:04:00 +0530 2 persons were carrying ganja in two suitcases by train from Durg to Sarnath and were planning to sell a certain quantity near Uslapur Railway Station, Bilaspur. The said information was entered in the Roznamcha. Acting upon the said information, the police reached Uslapur Railway Station and conducted search proceedings. Thereafter, on 24.08.2025 at about 07:35 AM, two persons carrying suitcases were seen near the station, who, upon seeing the police, attempted to Eee but were apprehended. On enquiry, they disclosed their names as Vinod Singh and Rupesh Singh. During the search, two mobile phones were recovered from the applicant, Vinod Singh, and from Rupesh Singh, one mobile phone, an Army identity card, Aadhaar card, voter identity card, train ticket, and cash amounting to Rs. 2,000/- were recovered. Upon search of both the suitcases, ganja weighing approximately 21 kg 100 grams was found and seized by the police. Consequently, an FIR was registered under Sections 20(B) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, and Sections 319, 388, and 340(2) of the Bharatiya Nyaya Sanhita, 2023, at Police Station Civil Lines, District Bilaspur (C.G.). 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case and the alleged contraband article i.e. 21 Kgs and 100 grams of ganja was not seized from the joint possession of the present applicant and other co-accused person. He also submits that the present applicant has no criminal antecedents and he is in jail since 24.08.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the charge-sheet has already been submitted before the competent Court in the present case. She 3 further submits that the quantity of contraband article i.e. 21.100 Kgs of Ganja, was recovered from the joint possession of the present applicant and other co-accused person, which is much above the commercial quantity and as such, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and further the fact that the contraband article which has been seized from the joint possession of the present applicant and other co-accused person which is much above the commercial quantity and the applicant has failed to give any explanation for the same and it cannot be a case of false implication. 7. Accordingly, the bail application of the applicant – Vinod Kumar Singh, involved in Crime No. 977/2025 registered at Police Station – Civil Line, District – Bilaspur (C.G.), for the oCence punishable under Section 20(B) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 319, 388 and 340(2) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8.
