V. Sireesha Rani, learned Standing counsel for the 5th respondent. 2. Assailing the notice vide R.O.C.No.603089/2023/G1 dated 23.05.2026 (Ex.P1), issued by the Commissioner of the 5th respondent, the petitioner filed the above writ petition. 3. Learned counsel for the petitioner would submit that the petitioner’s father constructed a house bearing No.16-373 at Medra Bazar, Chilakaluripet Mandal, Palnadu District, in or about August, 1974. The then Tahsildar assigned the plot, and thereafter, the house was constructed. The petitioner's father and, thereafter, the petitioner have been paying the property taxes in respect of the said house. 4. Be that as it may, the Commissioner of the 5th respondent issued Ex.P1 notice under Section 192 of the Andhra Pradesh Municipal Corporation Act, 1965. The petitioner submitted a reply/explanation dated 26.05.2026 (Ex.P2). Learned counsel for the petitioner would submit that without considering the explanation, the 5th respondent is attempting to demolish the house. 5. Sri M.Karthika Raja, learned counsel representing Smt. V.Sireesha Rani, learned Standing counsel for the 5th respondent, would submit that the authority will consider the explanation dated 26.05.2026 (Ex.P2), by giving an opportunity of hearing to the petitioner, pass a reasoned order and communicate the same to the petitioner. 6. Given the facts and circumstances of the case, inviting a counter and keeping the writ petition may not serve any purpose, and hence the writ petition is disposed of, at the stage of admission, with the consent of all the learned counsel, with the following directions: i) The 5th respondent shall consider the explanation dated 26.05.2026 (Ex.P2), and the other documents submitted by the petitioner. ii) The 5th respondent shall provide an opportunity of hearing to the petitioner, pass a reasoned order and communicate the same to the petitioner. iii) Till a reasoned order is passed, the 5th respondent shall not take any coercive steps pursuant to Ex.P1 in respect of the house bearing No.16-373 at Medra Bazar, Chilakaluripet Mandal, Palandu District. iii) There shall be no order as to costs.
