Despite the name of Mrs. Lily Sahay, learned A.P.P. appearing in the cause list, but none is present to represent the State. The prayer of bail of the petitioner was earlier rejected in B.A. No. 4882 of 2026. It has submitted by learned counsel for the petitioner that the informant has been examined as P.W.1 and she has been declared hostile. In fact, out of 08 charge sheet witnesses, 04 witnesses have been examined and all have been declared hostile. Learned counsel submits that the informant is the only eye witness to the occurrence and, therefore, her hostility has decimated the case of the prosecution. It appears from the allegations that the petitioner is said to have committed assault upon the father-in-law of the informant as a result of which he died. Since the informant, who is the main eye witness, has been declared hostile on the request of the prosecution, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Latehar in connection with Bariyatu P.S.
