This contempt petition has been filed by the petitioner under Section 12 of the Contempt of Courts Act, 1971 r/w. Article 215 of the Constitution of India alleging non-compliance of the order dated 26.11.2018 passed by this Court in WP(C) No. 703/2018. 2. The direction issued in the writ petition bearing WP(C) No. 703/2018 is extracted below for ready reference:- “1. In view of the fact that the respondents have taken a stand that the petitioner's land has neither been acquired nor used for construction of NH 200 contrary to the petitioner's submission that his land has been used for such construction, the Sub Divisional Officer (Revenue), Champa, is directed to demarcate the land belonging to the petitioner and show to him his land bearing Khasra No.146/2 & 146/3 on the spot and erect the boundary wall by poles with Barbed Wire fencing. The expenses of which shall be borne by the petitioner.” 3. Learned counsel for the respective respondents submits that pursuant to the order passed in the writ petition, demarcation of the land bearing Khasra No. 104/2 and 104/3 has been done and accordingly, the fencing was also done. It was also submitted that at the time of demarcation, it is found that some portion of the land of the aforementioned khasra numbers is under the State highway road. 4. The submission of counsel for the respondents is not opposed by the counsel for the petitioner that the demarcation of the aforementioned khasra numbers done by the respondents. He further submits that at the time demarcation, now they hae pointed out that some portion of the land of the petitioner is within the State highway road. 5. I have heard learned counsel for the parties and perused the documents 3 placed on record. 6. From perusal of the of the extracted portion of the order/direction dated 26.11.2018, it is apparent that there was direction to Sub-Divisional Officer (R) to conduct demarcation and after identifying the land, to surround it by barbed wire fencing. Undisputedly, demarcation was done and the land was also surrounded by fencing. 7. In view of the above, the respondents have complied the order passed by this Court. The contempt proceedings initiated against the respondents is dropped. Contempt petition is closed. 8. Notices issued to the respondents stands discharged Certified copy as per rules.
