Kausik (Allowed) CRM (NDPS) 1106 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kumarganj Police Station Case No. 419 of 2025 dated 06.12.2025 under Sections 21(c)/22(c)/23(c)/25/27A/28/29 of the NDPS Act, 1985. And In the matter of : Golam Rabbani Mandal ……Petitioner. Mr. Amitabha Ghosh Ms. Arpita Paul Biswas ……for the Petitioner. Mr. Anamitra Banerjee ……for the State. Learned advocate appearing for the petitioner submits that petitioner was arrested on 6th February, 2026 and is in custody since then. Charge sheet has already been submitted. However, charges are yet to be framed. The accusation against the petitioner is limited to the extent that from the bank of his pond there has been alleged recovery of 1034 bottles of Wincerex Cough Syrup. Learned advocate for the State opposes the prayer for bail and submits that the information was received and thereafter confirmed by the witnesses who were party to the seizure. The Chemical Examiner’s Report do corroborate the prosecution case. There are documents to substantiate regarding the ownership of the said land. 2 However, I find that there are 13 witnesses on whom the prosecution relied upon, the trial would consume some time. Having regard to the period of detention, the time which will be consumed by the State in order to take the trial to its logical conclusion, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Golam Rabbani Mandal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1106 of 2026 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
