Neutral Citation No. ( 2026:JHHC:29044-DB ) IN THE HIGH COURT OF JHARKHAND AT RANCHI Criminal Appeal (DB) No. 968 of 2026 Md. Sagir Ansari @ Sagir Ansari ... Appellant Versus The State of Jharkhand … Respondent --- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY HON'BLE MR. JUSTICE RAM SHARMA For the Appellant : Mr. Karan Kaushik, Advocate For the State : Spl.PP --- Order No. 04 Dated 28th September, 2026 Heard the learned counsel for the respective sides. This appeal is directed against the order dated 30.04.2026 passed by the learned A.J.C.-IV-cum- Spl. Judge, POCSO Act, Ranchi in MCA No. 690 of 2026 in connection with Sadar P.S. Case No. 125 of 2026, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that the daughter of the informant went missing and on 15.03.2026, the informant had met her daughter at Gola Chowk, Ranchi after which she was brought home with the help of the police. The daughter of the informant had later on disclosed that her aunt had enticed her away for engaging her in some household work and took her to Ormanjhi where one person came and she was handed over to the said person and thereafter several persons had made an attempt to commit rape upon her, but she somehow managed to escape. Submission has been advanced by the learned counsel for the appellant that the implication of the appellant seems to be on the confessional statement of co-accused Anju Munda. It has been submitted that the appellant had also subsequently confessed. Learned counsel submits that no Test Identification Parade has been held to ascertain as to whether the appellant was one of the persons who was involved in attempting to commit rape upon the victim. Learned counsel adds that the appellant is in custody since 23.03.2026. Learned Spl.PP has opposed the prayer for bail of the appellant. On a perusal of the case diary which has been produced by the learned Spl. P.P. it does seem that it was Anju Munda who had confessed and named the appellant consequent to which the appellant had also made a confessional statement. There is nothing in the case diary which would indicate that the appellant was one of the persons who was involved in attempting to commit rape upon the victim and even the Test Identification Parade has also not been held. On consideration of the aforesaid facts, we while setting aside the order dated 30.04.2026 passed by the learned A.J.C.-IV-cum- Spl. Judge, POCSO Act, Ranchi in MCA No. 690 of 2026 in connection with Sadar P.S. Case No. 125 of 2026, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like mount each to the satisfaction of learned A.J.C.-IV-cum- Spl. Judge, POCSO Act, Ranchi in connection with Sadar P.S. Case No. 125 of 2026. This appeal is allowed. (RONGON MUKHOPADHYAY, J.) (RAM SHARMA, J.) 28.09.2026 MK Page-2
