Kausik (Allowed) CRM (NDPS) 1277 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kumarganj Police Station Case No. 419 of 2025 dated 06.12.2025 under Sections 21(c)/22(c)/23(c)/25/27A/28/29 of the NDPS Act. And In the matter of : Samsul Mandal ……Petitioner. Mr. Kaushik Choudhury Mr. Dwipayan Panda Mr. Tridib Das ……for the Petitioner. Mr. Debajyoti Deb Mr. Sanjib Das ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody since 8th March, 2026 and petitioner is innocent of the charges. Charge sheet has been submitted. As such, the petitioner may be released on bail. Learned advocate appearing for the State opposes the prayer for bail and submits that there was continuous communication between the present petitioner and the owner of the pond. There are call date records to that effect. I have taken into account the factum that subsequent to the arrest of the petitioner there has been no recovery and there are no criminal antecedents so far as the present 2 petitioner is concerned. Having considered the period of detention of the present petitioner, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Samsul Mandal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Special Court. Thus, CRM (NDPS) 1277 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
