1. 2. As per the prosecution case, the complainant, Shankar Das Baghel, who runs a provision store in front of Jharaghati Police Station, lodged a written report alleging that on 19.11.2025, two persons visited his shop and, on the pretext of taking delivery of a refrigerator, cold drinks and the shop’s board, received an amount of Rs.10,000/- in cash and Rs.23,560/- through PhonePe. Thereafter, the accused persons allegedly became untraceable as their mobile phones were switched off/not reachable, thereby dishonestly cheating the complainant. On the basis of the said report, the present crime was registered against the applicant and other accused persons.
3.
Learned counsel for the applicant submits that the applicant has already repaid the alleged amount and the dispute has been amicably settled with the complainant, who has filed an affidavit before the trial Court expressing no objection to the grant of bail. It is also argued that the alleged transaction was purely of a business nature and, since the applicant was always available at his place of business, his arrest without issuance of notice under Section 35(3) of the BNSS, 2023 was illegal. Lastly, it is submitted that the applicant has been in judicial custody since 27.05.2026 and, therefore, considering the aforesaid circumstances, he deserves to be enlarged on bail. 4. Mr. Anshit Singh Hora, learned counsel for the complainant submits that he has filed an application seeking no objection in the grant of bail to the applicant. 3
5. Taking into consideration the above-stated facts and affidavit filed by the complainant regarding no objection for grant of bail to the applicant, this Court is of the opinion that it is a fit case to enlarge the applicant on bail. Accordingly, the bail application of the applicant is allowed. 6. Let applicant, Badal Singh, involved in Crime No.01/2026, registered at Police Station- Jharaghati, District- Narayanpur (C.G.) for the offence punishable under Sections 318(4), 336(3) and 340(2) of the BNS, be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with one surety with the following conditions:- (i) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (ii) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against them under Section 269 of Bharatiya Nyaya Sanhita.
(iii) In case, the applicant misuses the liberty of bail during trial and in order to secure his presence proclamation under Section 84 of Bharatiya Nyaya Sanhita is issued and the applicant fails to appear
4 before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against him, in accordance with law, under Section Section 209 of Bharatiya Nyaya Sanhita. (iv) The applicant shall remain present, in person, before the trial court on the dates fixed for (i) opening of the case, (ii) framing of charge and (iii) recording of statement under Section 351 of BNSS. If in the opinion of the trial court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the trial court to treat such default as abuse of liberty of bail and proceed against him in accordance with law. 7. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/- (Ravindra Kumar Agrawal)
