The Court made the following: ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.176 of 2025 of Kothavalasa Police Station, Vizianagaram District, registered against the Petitioner/Accused No.1 herein for the offences punishable under Sections 20(b)(ii)(B) read with 8(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Heard the learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. On perusal of the record, the allegation against the Petitioner/Accused No.1 is that he was in possession and transportation of 1 kg of ganja. It is not a commercial quantity. There is one adverse case of a similar nature reported against the Petitioner in the State of Kerala. The Petitioner is a permanent resident of Meppadi Village & Post, Kottappadi, Wayanad District, Kerala State. He has got fixed abode. The Petitioner was arrested on 08.12.2025. He has been in judicial custody for the past 28 days. No application has been filed seeking his custodial interrogation. So far, 5 witnesses have been examined. Substantial portion of the investigation with regard to the alleged role played by the Petitioner in this case has been completed. There is a fat chance for the petitioner to escape from the clutches of law if he is enlarged on bail. 3 Dr.YLR,J Crl.P.No.13360 of 2025 Dated 05.01.2026
