The applicant has preferred this First Bail Application under Section 483 of B.N.S.S. for grant of regular bail, as he has been arrested in connection with Crime No. 96/2026, registered at Police Station - Doundilohara, District – Balod, (C.G) for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act. 2. As per the prosecution story, in brief, it is alleged that on 03.04.2026, the police received secret information that the present applicant was selling illicit liquor near the paddy market. Acting upon the said information, the police conducted a raid, during which the present applicant was apprehended. It is further alleged that 40 bottles of country-made liquor, MANPREET KAUR Digitally signed by MANPREET KAUR Date: 2026.07.20 18:08:31 +0530 2 each containing 180 ml (totalling 7.200 bulk litres), were recovered from the possession of the present applicant. As the applicant failed to furnish any satisfactory explanation for possessing the said liquor, the police registered the aforesaid FIR against him and seized the recovered liquor. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and that no seizure has been effected from the exclusive possession of the applicant. He further submits that at present the applicant has no criminal antecedents pending against him. He also submits that under Section 34(2) of the Chhattisgarh Excise Act, the minimum punishment prescribed is one year and the maximum punishment is three years. It is further submitted that the applicant has been in judicial custody since 06.06.2026, and the conclusion of the trial is likely to take a considerable amount of time. Therefore, he prays that the applicant be released on regular bail. 4. On the other hand, learned State Counsel appearing for the State/non- applicant opposes the bail application and submits that in the present case charge-sheet has been filed before the competent Court. She also submits that 40 bottles of country-made liquor, totalling 7.200 bulk litres, were recovered from the possession of the applicant, and as he failed to furnish any satisfactory explanation for possessing the same, therefore, he is not entitled to be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, particularly the fact that during the raid the applicant was allegedly found selling illicit liquor and 40 bottles of country-made liquor, totalling 7.200 bulk litres, were recovered from his possession, and that he failed to furnish any satisfactory explanation for possessing the same, as well as considering 3 the period of his detention since 06.06.2026, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant – Shravan Kumar, involved in Crime No. 96/2026, registered at Police Station - Doundilohara, District – Balod, (C.G) for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
