GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 36527/2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue order or direction more particularly one in the nature of Writ of MANDAMUS declaring action of the respondent Nos.4 and 5 in collusion with the respondent Nos.6 and 7 in preventing the petitioner from entering the Hanuman temple at Gangavaram Village and Mandal, Alluri Sitha Rama Raju District as wholly Illegal, arbitrary and in violation of the Art.14 and 21 of the Constitution of India and consequently direct the respondents not to interfere with petitioner’s life and personal liberty and insisting him to relocate the temple from the present place in Gangavaram Village and Mandal Alluri Sitha Rama Raju District, in the interest of Justice.…” 2. Heard Sri Musudi Babji, learned counsel for the petitioner and Sri P.Ajay Babu, learned Assistant Government Pleader for Home for the respondents. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that basing on the complaints of the petitioner and as well as the 6th respondent, a case and counter case have been registered in Crime No.103 of 2024 and Crime No.104 of 2024 on the file of Gangavaram Police Station against the petitioner and the unofficial respondents and investigation in these matters is pending. He would further submit that except registration of the above crimes, the police never insisted the petitioner to relocate the temple from the present place. 4 4. Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 5. Recording the same, this Writ Petition is disposed of. However, the petitioner is at liberty to work out his remedies before the competent Civil Court regarding the rights over the subject property. No order as to costs.
