This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division), 3rd Court at Barasat to dispose of Title Suit No. 101 of 2020 expeditiously. Ms. Bhattacharya, learned advocate appearing for the petitioner submits that the suit for eviction under the West Bengal Premises Tenancy Act, 1997 inter alia on the ground of reasonable requirement is pending from the year 2020. She further submits that though the Commission work has already been concluded, the Commissioner’s report is yet to be accepted. From the order-sheets appended to this civil revision application this Court finds that August 1, 2026 has been fixed for acceptance of the Commissioner’s report. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any
2 notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing them before the learned trial judge. In the light of the submission made by Mr. Bhattacharya, learned advocate appearing for the petitioner, CO 2138 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Division), 3rd Court at Barasat to take up the matter for consideration of the issue relating to acceptance of the Commissioner’s report on the next date fixed, i.e., on August 1, 2026 and make an endeavour to dispose of Title Suit No. 101 of 2020 as expeditiously as possible without granting any unnecessary adjournment to either of the parties keeping in mind that the suit is a suit for eviction inter alia on the ground of reasonable requirement.
