1. THE STATE OF A P, .,Rep by its Public Prosecutor, High Court of A.P., Amaravati, Guntur District.
...RESPONDENT/COMPLAINANT Counsel for the Petitioner/accused:
1. VENKAT CHALASANI Counsel for the Respondent/complainant:
1. PUBLIC PROSECUTOR The Court made the following:
ORDER:
This Criminal Petition under Section 482 of B.N.S.S., is filed by the Petitioner herein/A10 seeking to grant anticipatory bail in Crime No.251 of 2025 of Badvel (U) Police Station, Kadapa District, registered for the offences punishable under Sections 318(4), 338, 336(3), 340(2) and 342(1) of BNS.
2. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor for the State.
3. Case of the prosecution, in brief, is that prior to 19.07.2025, T. Ramanamma purchased a house plot in Survey No. 1012 of Madakalavaripalle Gram Panchayat from the accused Ratnamma through a registered sale deed. Upon verification, the complainant found that the DKT
2
patta was not recorded in the revenue records and that the said DKT patta was forged. In this connection, a case was registered and investigated. During the course of investigation, on 24.07.2025, the Investigating Officer arrested A2, who confessed that they had fabricated the revenue records.
4.
Learned counsel for the petitioner submits that the petitioner has not committed any offence and has been falsely implicated in the present crime. He is the sole breadwinner of his family and is ready to abide by any conditions that may be imposed by this Court. It is therefore urged that pre- arrest bail be granted to the petitioner.
5. Learned Assistant Public Prosecutor vehemently opposed for grant of anticipatory bail to the petitioner.
6. On hearing both sides and on perusal of the material on record, it is seen that a Coordinate Bench of this Court, vide order dated 28.08.2025 in Crl.P.No. 8426 of 2025, dismissed the anticipatory bail application of the petitioner herein/A10 by specifically making adverse observations against the petitioner with reference to direct bank transactions between A1 and the petitioner/A10. The specific allegation against the petitioner is that he funded the amounts for the alleged offence. In that view, the learned Single Judge of this Court opined that grant of pre-arrest bail to the petitioner is not desirable. There are no changed circumstances to entertain the present anticipatory bail application of the petitioner.
7. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner.
3
8. Accordingly, the Criminal Petition is dismissed.
9. Registry is directed not to entertain any further anticipatory bail petition filed by the petitioner herein relating to present crime.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed. __________________________________ Dr.VENKATA JYOTHIRMAI PRATAPA, J
