This Criminal Appeal (SJ) has been filed against the judgment of conviction and order of sentence dated 31.01.2012 passed in Case No.R.C.35A/1996 by the learned Special Judge-I, C.B.I. (A.H.D. Scam Cases), Ranchi. By the said judgment, the appellant was held guilty under Sections 420, 465, 467, 468, 471 of the Indian Penal Code, 1860. 3. The appellant was sentenced to undergo rigorous imprisonment for 5 years along with a fine of Rs.5,00,000/- under Section 420, 465, 468, 471 read with 120-B of IPC, and in default of fine S.I. of 4 months each. However, the learned court passed order that the sentences shall run concurrently. 4. Learned counsel for the appellant has submitted that the appellant has expired and their legal heirs do not want to pursue the appeal, but the death certificate has been forwarded to the learned counsel for the appellant which has been placed on record along with the mention slip. He submits that accordingly this appeal has abated and the learned counsel for the appellant does not want to press the present appeal. 5. Learned counsel for the CBI has no objection so far as the aforesaid prayer of the appellant is concerned. 2026:JHHC:28883 2 6. Considering the submissions, this appeal is treated as abated. 7.
