Item- 43. sg 08-07-2026 Ct. 6 CO 2173 of 2026 Subhendu Dey Versus Labanya Roy [ Mr. Aniket Mitra …for the petitioner On the prayer of the learned Advocate apperiong for the petitioner, leave is granted to the learned advocate-on- record for the petitioner to amend the cause title of this civil revisional application, here and now. This application under Article 227 of the Constitution of India is at the instance of the defendant No. 2(b) praying for a direction upon the Learned Civil Judge (Senior Division), 6th Court at Alipore, to dispose of the application for appointment of receiver within a specified time frame. The learned Advocate appearing for the petitioner draws attention of this Court to the order dated 3rd December, 2021 passed in CO 1641 of 2021 directing the learned Trial Judge to dispose of the said application expeditiously. He further refers to another order dated 2nd May, 2024 passed in CO 1573 of 2024 wherein a coordinate Bench directed the learned Trial Judge to dispose of the said application within a year from the next date fixed. He further submits that in spite of repeated directions passed by this Court, the application is yet to be disposed of. He submits that the application is otherwise ready for hearing. He submits that 7th July, 2026 was the date fixed for hearing of the said application and the hearing of such application was adjourned on the prayer of the fourth defendant. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioners shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division), 2nd Court, Alipore, to take up the hearing of the application for appointment of receiver on the next date fixed and to dispose of the same as expeditiously as possible, but positively within a period of four months from the next date fixed without granting any unnecessary adjournments to either of the parties.
