JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused No.2 is before this Court calling in question proceedings in C.C.No.31278/2023, pending before the IX Additional Chief Metropolitan Magistrate, Bengaluru, for the offences under Sections 341, 323, 324, 504, 506 and 34 of the IPC. 2. Learned counsel for the petitioner and respondent No.2 in unison would submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed a memo along with joint - 3 - HC-KAR NC: 2026:KHC:33818 CRL.P No. 16770 of 2025 affidavit before this Court seeking permission to compound the offences. 3. The joint memo reads as follows: “1. We state that the criminal proceedings were Initiated against the Petitioner following a complaint lodged by Respondent No. 2 with the RMC Yard Police Station, Bengaluru, in Crime No. 137/2023. This resulted in the final chargesheet of C.C. No. 31278/2023 date 10.10.2023 pending on the file of the Hon'ble IX Additional Chief Metropolitan Magistrate Court at Bengaluru, for alleged offences punishable under Sections 341, 323, 324, 504, 506, read with Section 34 of the Indian Penal Code, 1860, wherein the Petitioner is arrayed as Accused No. 2. 2. We state that we are fully conversant with the facts and circumstances of the case, and being the parties to the dispute, we are competent and authorized to swear to and sign this Joint Affidavit. 3. We submit that with the intervention of elders and well- wishers, we have amicably settled the dispute between us out of court and have mutually agreed to close the present criminal proceedings. 4. We state that we have compromised the matter on the following terms and conditions: (i) The Petitioner undertakes that he will not interfere in any matter relating to Respondent No. 2 in the future. (ii) Respondent No. 2 undertakes that he will not interfere in any matter relating to the Petitioner in the future. (iii) I, Respondent No. 2 (Vikram Babu Rednekar), state that the Petitioner is a young student. As the matter is settled and I wish to safeguard the academic future of the young student, ensuring that his life is not adversely - 4 - HC-KAR NC: 2026:KHC:33818 CRL.P No. 16770 of 2025 affected by these prolonged legal proceedings, I am fully and wholeheartedly agreeing to this compromise. (iv) I, Respondent No. 2, further submit that I have given my consent to quash the proceedings against the Petitioner voluntarily, out of my own free will, and without any undue influence, coercion, or force from any corner. (v) We jointly request this Hon'ble Court to kindly accept this settlement and dispose of the proceedings as prayed for. 5. We undertake to strictly abide by the terms of this settlement and further undertake not to file any civil or criminal cases against each other regarding this subject matter in the future. 6. We state that the statements made in the paragraphs above are true and correct to the best of our knowledge, information, and belief.” In the light of the afore-quoted joint affidavit of the parties, I deem it appropriate to terminate the proceedings against the petitioner, as the dispute and the allegations are between the individuals and not against the State. 4.
