Bardhan, Advocate ------ 03/ 01.04.2026 By filing this writ petition, the petitioners have prayed for the following reliefs:- “A. Issuance of an appropriate writ, order or direction, particularly a writ in the nature of Mandamus restraining the Respondents from forcibly evicting or demolishing the houses, shops and establishments of the Petitioners situated within the colony area of the Respondent No.1. B. Directing the Respondents not to dispossess the Petitioners from their respective houses, shops and establishments except in accordance with due process of law. C. Pass an appropriate order staying any eviction or demolition action against the Petitioners during the pendency of the present writ petition.” 2. Heard learned counsel representing the petitioners and learned counsel representing the respondents. 3. It is a case where admittedly the petitioners have got no title over the property in question. The petitioners made some construction and started living over the property. They are claiming that initially their grandfathers were orally given the property in question on lease for eleven months and thereafter, some of them were allotted through Agreement of Lease on monthly rent basis, thus they are occupying the property. 2026:JHHC:9473 4 4. Admittedly, the petitioners are not claiming title over the property in question and now there is no extension of the license of the lease. Admittedly the petitioners accept that the land belongs to the respondents. 5. Today a supplementary affidavit dated 30.03.2026 has been filed by the petitioners. In para-4 of the said affidavit, the petitioners have categorically given an undertaking before this Court that they will hand over the peaceful and vacant possession of the premises in question to the respondents within two months, from the date of undertaking. 6. The respondents oppose the aforesaid proposal of the petitioners. 7. Considering the undertaking given by the petitioners before the Court on oath, as two months’ time is necessary to find an alternative accommodation to reallocate themselves, thus two months’ time is granted to the petitioners from today itself to vacate the premises. 8. It is made clear that if any of the petitioners fail to comply with the said undertaking, they will be proceeded against under the Contempt of Courts Act. 9.
