Learned advocate appearing for the petitioner submits that the petitioner is in custody for one year two months and 12 days and is similarly situated as the other accused person who has been granted bail in CRM (M) 2499 of 2025. Mr. Rajendra Banerjee, learned Additional Public Prosecutor along with Mr. Bankim Pal are appearing for the State. Their appointments may be regularized by the concerned authorities. I have taken into account the statement of the witnesses and in spite of the objection raised on behalf of the State, I am inclined to release the petitioner on bail. As such, the petitioner namely, Jiban Das be released on bail on same terms and conditions as was imposed upon Swapan Bhowmik in CRM (M) 2499 of 2025, subject to the satisfaction of the learned Chief Judicial Magistrate, Raiganj, Uttar Dinajpur.
2 Accordingly, the prayer for bail of the petitioner in CRM (M) 2861 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
