Ray Mr. Madhu Jana Mr. Subhajit Das …. For the State Affidavit of service filed on behalf of the petitioners is taken on record. The Panchayat is not represented despite service. Pursuant to an advertisement issued by the Public Service Commission, West Bengal being no. 05/2019 the petitioners appeared for the clerkship examination and were appointed to the post of Lower Division Clerk (Group C) in various districts of State of West Bengal. They filed an application under the Right to Information Act, 2005 before the State Public Information Officer and Panchayat and Rural Development Department on 25th July, 2025 seeking to know whether they were State Category Employees or District Category Employees. Several queries were made by the petitioners in the said application some of which were responded to by the authority by referring to notifications dated 18th January, 2007 and 24th January, 2019. The petitioners submitted a representation before the concerned authority on 23rd 2 December, 2025 praying for being treated as State Category Employee, preparation and publication of State wise seniority cum gradation list for the LDC/ LDA employees posted in different regional offices under the Panchayat and Rural Development, Government of West Bengal as per merit/rank in the clerkship examination. The said representation is yet to be considered. The petitioners seek consideration of the same. Learned counsel for the State submits that the representation be considered in accordance with law. In view of the above, the Deputy Secretary, Panchayat and Rural Development Department, Government of West Bengal being the 2nd respondent herein is directed to consider and dispose of the representation submitted by the petitioner dated 23rd December, 2025 within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to the petitioners, in accordance with law. The decision taken by the authority shall be communicated to the petitioners within a week thereof. In the event the concerned authority arrives at a decision in favour of the petitioners, necessary consequential steps be taken by the authority at the earliest. The writ petition is accordingly disposed of. 3 There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities (Suvra Ghosh, J.)
