Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 2 months and the subject-matter of the present case relates to alleged recovery of 1391 grams of Brown Sugar. It has been submitted that one of the accused persons has been granted bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there was no recovery from the person who has been granted bail and the present petitioner is not similarly situated as the other accused who has been granted bail. Having considered the quantum of recovery in the present case, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.
2 However, the learned Trial Court would within a period of five months from the date of framing of chare, take steps for examination of the independent seizure list witnesses. The petitioner will renew his prayer for bail after the aforesaid time period is over. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 959 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
