1. The present writ petition has been filed seeking a direction to the respondent no.1/MCD to demolish the unauthorized construction being carried out by the owners of property bearing no. L-69, Kalkaji, New Delhi- 110019 (hereinafter the ‘subject property’).
2. Counsel appearing on behalf of the petitioner submits that the petitioner is an immediate neighbour of the subject property.
3. Counsel appearing on behalf of the respondent no.1/MCD, on advance notice, submits that the aforesaid construction has been carried out This is a digitally signed order. 4. To be noted, owner/ occupier of the subject property has not been impleaded as a party in the present petition.
5. In view thereof, counsel appearing on behalf of the petitioner seeks to withdraw the present petition, with liberty to file a fresh petition, if necessary, with better particulars and impleading necessary parties.
6. The present writ petition is dismissed as withdrawn with the aforesaid liberty.
