(2) According to petitioner, her husband was employed as Gardner/Mali in Horticulture Department, who died while in service on 8.1.2019. According to petitioner, her husband was entitled to benefit of 3rd ACP w.e.f. 1.11.2013, pursuant to Government Order dated 7.9.2015, however the said benefit was not given to him during his lifetime. In this writ petition, petitioner has sought the following reliefs: “(i) Issue a Writ, Order or Direction in the nature of mandamus directing the respondents to release the benefits of sanctioned ACP as per office order dated 07.09.2015 (Annexure No. 2) issued by Respondent No. 1. (ii) Issue writ, order or direction in the nature of mandamus commanding the Respondents to give the benefits of sanctioned ACP to the petitoner.” (3) Having regard to the fact that petitioner has sought a writ of mandamus, this Court thinks that ends of justice would be met if petitioner is permitted to make a representation. Writ petition is, accordingly, disposed of by permitting the petitioner to make representation. If she makes representation within ten days from today before respondent no. 3, the decision thereupon shall be taken, as per law, within three months thereafter.
