This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicants arrested in connection with Crime No. 77/2026 registered at Police Station – Rakhi, District – Raipur (C.G.) for the offence punishable under Section 296, 115(2), 351(2), 118(2) and 3(5) of the BNS. 2. Case of the prosecution, in brief, is that on 23/04/2026 the complainant namely Raghunath Yadav lodged a written report before police station Rakhi, District Raipur. It is alleged that on 21/04/2026 in the night at about 11.00 Hours received information through Mobile Phone that his son Yogesh Yadav was committed marpit by the applicant then after he reached in Police station Rakhi RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 and he stated that he along with his friend Deva Dhiwar visit in village Rakhi at that same time villager of Rakhi Gofe Dhiwar and Komal Dhiwar having enmity and quarrel has been started and committed marpit and stated that why you come here and started filthy language in the name of mother and sister and threatening to kill his life and committed marpit with hand and fist and having sharp like weapon and Yogesh (injured) received grievous injury to his back of the body, waist and other part of body. Thereafter the injured Yogesh taken into Krishna hospital Abhanpur for further treatment. On the basis of above report the concerned police investigated the matter and registered the crime against the present applicant. Hence, this application. 3. Learned counsel appearing for the applicants submits that the applicants are innocent and has been falsely implicated in the present case and the chargesheet has been filed in this case. It is submitted that the applicants are in jail since 11.05.2026, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel, opposes the bail application and submits that the applicant along with the co-accused is said to have assaulted the injured, and the applicant who was armed with a knife has caused injuries to the injured and the injured has received two incise wound and one of the injuries received by him is on chest and the injuries were found to be grievous in nature and found on the vital part of the body. As such, the bail application deserves to be rejected. 3 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and also considering the fact that the applicant along with the co- accused is said to have assaulted the injured, and the applicant who was armed with a knife has caused injuries to the injured and the injured has received two incise wound and one of the injuries received by him is on chest and the injuries were found to be grievous in nature and found on the vital part of the body, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicants on regular bail. 7. Accordingly, this bail application of applicant – Komal Tarak, involved in Crime No. 77/2026 registered at Police Station – Rakhi, District – Raipur (C.G.) for the offence punishable under Section 296, 115(2), 351(2), 118(2) and 3(5) of the BNS, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
