IN THE HIGH COURT AT CALCUTTA [ CIRCUIT BENCH AT PORT BLAIR ] *** WPA/350/2026 Smti. Bibi Fathima Vs The Andaman and Nicobar Administration and Others Mr. Lokesh Chezian N. … for the petitioner Mr. S. C. Mishra … for the respondents July 10, 2026 [AKB] Item No.8 The writ petitioner is aggrieved by the order dated June 23, 2026 whereby the petitioner’s application for grant of electricity supply has been rejected on the ground of submission of “incorrect affidavit”. Mr. Chezian, learned Advocate appearing for the petitioner submits that the petitioner had taken all care to file a proper affidavit yet, the petitioner’s application has been rejected by a cryptic order stating that “incorrect affidavit” has been filed. It is submitted that the respondents have not indicated as to what was incorrect in the affidavit and what should be done to rectify the same. There is force in the submission of Mr. Chezian that if the affidavit was incorrect, and the electricity authorities rejected the application on such ground then the error or the perceived incorrectness should have been indicated in the order of rejection so as to enable the applicant to take appropriate steps. In such view of the matter, this writ petition is disposed of by directing the respondent electricity authorities to inform 2 the petitioner in writing as to the reasons wherefor the petitioner’s affidavit has been said to be incorrect within 10 days from date. The petitioner is granted liberty to make a fresh application upon incorporating the correct relevant details as may be indicated by the respondent electricity authorities in terms of this order. If such fresh application along with appropriate affidavit is made by the petitioner, respondent electricity authorities shall consider and dispose of the same in accordance with law within a month from the date of making of such application. With the aforesaid observations, WPA/350/2026 stands disposed of. No costs. (Om Narayan Rai, J.)
