At the very outset, learned counsel for the petitioner submits that WPC No. 1181 of 2026 has become infructuous as his grievance has been redressed. 2. In WPC No. 2529 of 2026 The petitioner has filed the instant petition for following reliefs:- “10.1 That, this Hon’ble Court may kindly allow this petition and direct the respondent No. 2 Collector to 3 implement the order passed by the learned commissioner and restore the sealed Gas Agency of the petitioner, in the interest of Justice. 10.2 Any other relief which deemed fit and proper may also be issued looking to the facts and circumstances of the case and looking to the interest of the petitioner. “ 3. Learned counsel appearing for the petitioner submits that, despite the orders dated 30.01.2026 and 25.03.2026 passed by the Commissioner, Raipur Division, Raipur (C.G.), directing the Collector (Food Branch), District Mahasamund (C.G.), to pass an appropriate order in accordance with law, no action has been taken till date. It is, therefore, prayed that this Hon'ble Court may be pleased to direct the concerned Collector to consider and decide the petitioner's case expeditiously in terms of the aforesaid orders dated 30.01.2026 and 25.03.2026. 4. Learned counsel appearing for the State/respondents No. 1 to 4 submits that the petitioner's case shall be considered and decided by the concerned Collector in compliance with the directions issued by the Commissioner, Raipur Division, vide orders dated 30.01.2026 and 25.03.2026. It is further submitted that, since WPC No. 1181 of 2026 has become infructuous, the concerned Collector shall proceed to decide the petitioner's case independently on its own merits, in accordance with law. 5. Having heard learned counsel for the parties and considered the rival submissions advanced on behalf of the petitioner, the respondent/Indian Oil Corporation, as well as the State, this Court is of the view that once the Commissioner, Raipur Division, has passed orders dated 30.01.2026 and 25.03.2026 directing the Collector (Food 4 Branch), District Mahasamund, to take an appropriate decision in accordance with law, it is incumbent upon the said authority to comply with the directions contained therein. Accordingly, the Collector (Food Branch), District Mahasamund, is directed to consider and decide the petitioner's case strictly in accordance with law, keeping in view the directions contained in the Commissioner's orders dated 30.01.2026 and 25.03.2026. While doing so, the Collector shall also take note of the fact that WPC No. 1181 of 2026 has already become infructuous and shall decide the matter independently on its own merits, uninfluenced by the pendency of the said writ petition. Considering that the dispute pertains to an essential commodity and requires expeditious resolution, the Collector shall pass an appropriate order within a period of 15 days from the date of receipt of a copy of this order. 6. With this observation and direction, the petition WPC No. 2529/2026 stands disposed of and WPC No. 1181 of 2026 stands dismissed as having become infructuous.
